1. About Helmet Heroes

Helmet Heroes Foundation, Inc. ("Helmet Heroes", "we", "our", or "us") is a non-profit organisation registered in Wyoming, United States (Registration ID: 2025-001786508), operating a road-safety initiative in Pattaya, Thailand.

Our campaign distributes TIS-certified motorcycle helmets to school children in Thailand. We run fundraising campaigns in partnership with schools, including Tara Pattana School, through our website at helmetheroesthailand.org.

2. Acceptance of Terms

By accessing our website or making a donation through our platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our platform or make a donation.

These terms apply to all visitors, donors, and any other person who interacts with our website or campaign pages.

3. Eligibility

You must be at least 18 years of age to make a donation through our platform. By making a donation, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

Donations may be made on behalf of a student by a parent, guardian, teacher, or any other adult donor. The student on whose behalf the donation is made does not need to be 18 years old.

We reserve the right to decline or reverse any donation at our sole discretion, including where we have reason to believe the transaction is fraudulent.

4. Donations & Payments

All donations are made in Thai Baht (THB). Each helmet costs ฿700. You may donate any amount of ฿700 or more; the number of helmets funded is calculated by dividing your total donation by ฿700.

We accept the following payment methods:

• Credit or debit card: Processed securely via Stripe. You will be redirected to Stripe's hosted checkout page. Your card details are never seen or stored by Helmet Heroes.
• PromptPay: Manual bank transfer using the QR code and unique reference code provided on the form. PromptPay donations are verified manually within 24 hours of submission against bank records.

For card payments, your donation is confirmed automatically once Stripe notifies us of a successful payment. For PromptPay donations, your donation will appear on the leaderboard only after manual verification by our team.

A unique reference code (e.g. HH-NON-48291) is generated for each donation submission. You should retain this reference code. For PromptPay, please include this reference code in your bank transfer note to ensure prompt matching.

5. No Refund Policy

If you believe a payment was made in error due to a technical fault on our platform, please contact us at legal@helmetheroesthailand.org within 48 hours and we will investigate. We are not able to guarantee a refund in any case, but we will review genuine error claims in good faith.

In the event of a duplicate PromptPay transfer (two transfers for the same reference code), the excess amount will be applied as an additional donation rather than refunded, unless we are contacted within 48 hours of submission.

6. Use of Funds

All donations received through this platform are used to fund the purchase and distribution of TIS-certified motorcycle helmets for children in Thailand, in support of the specific campaign for which the donation was made.

Helmet Heroes operates on a lean model and directs the substantial majority of funds raised to the purchase of helmets. A small portion may be used to cover unavoidable operational costs such as payment processing fees charged by Stripe (typically 1.5–3% per transaction).

We reserve the right to apply surplus funds raised beyond the campaign target to future Helmet Heroes campaigns or related road-safety initiatives in Thailand.

7. Prizes & Certificates

Prizes and awards listed on the campaign page are offered in good faith based on current campaign targets and sponsor commitments. By making a donation that reaches a prize tier, you become eligible for the corresponding prize, subject to the following conditions:

• Prizes are awarded at a ceremony at the partner school at the end of the campaign period. The ceremony date is announced by Helmet Heroes.
• Physical prizes (shirts, trophies, framed certificates) are available for collection at the ceremony or, where logistically possible, by arrangement with Helmet Heroes at legal@helmetheroesthailand.org.
• World Record prizes (including the World Record Participation Certificate) are contingent on the school collectively reaching the 5,555-helmet target. If the target is not reached, donors at this tier will receive a standard Certificate of Recognition instead.
• Legacy Sponsor prizes (555+ helmets) are subject to individual arrangement with Helmet Heroes. Please contact us directly after donating at this level.

Certificates are generated as a PDF and emailed to card-payment donors upon successful payment. The PDF is print-ready and suitable for home or professional printing. The certificate bears your name as entered at Stripe checkout. We cannot re-issue certificates with a different name after the fact.

Helmet Heroes reserves the right to modify prize details at any time due to circumstances beyond our control, including changes in sponsorship availability. We will notify affected donors directly in such cases.

8. Leaderboard & Public Display

By making a donation and entering a student's details, you consent to the following information being displayed publicly on the campaign leaderboard:

• The student's first name and surname initial (e.g. "Nong S.")
• The student's grade and class team
• The number of helmets funded on the student's behalf

Donor names may also appear on the donor leaderboard. If you wish to donate anonymously, enter "Anonymous" in the donor name field.

No donor email addresses or payment details are ever displayed publicly.

Encouragement messages submitted with a donation may be displayed on the campaign page alongside the student's name. By submitting a message, you grant Helmet Heroes a non-exclusive, royalty-free licence to display that message on the campaign page during the campaign period.

9. Prohibited Conduct

You agree not to use our platform to:

• Submit false, misleading, or fraudulent donations or payment information.
• Attempt to manipulate the leaderboard through duplicate, fraudulent, or reversed payments.
• Submit inappropriate, offensive, or defamatory content in any encouragement message field.
• Interfere with, disrupt, or attempt to gain unauthorised access to our website, servers, or databases.
• Use our website in any way that violates applicable local, national, or international law.

We reserve the right to remove any submission, cancel any donation, or ban any user who violates these terms, at our sole discretion and without prior notice.

10. Intellectual Property

All content on this website — including text, graphics, logos, images, certificates, and campaign materials — is the property of Helmet Heroes Foundation, Inc. or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on this website without our express written permission, except that you may share your personal certificate for non-commercial purposes (e.g. on social media) provided you do not alter it and you credit Helmet Heroes Thailand.

The Helmet Heroes name, logo, and branding are trademarks of Helmet Heroes Foundation, Inc. Unauthorised use is strictly prohibited.

11. Disclaimers

Our website and campaign platform are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Helmet Heroes disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the website will be uninterrupted, error-free, or free from viruses or other harmful components. We are not responsible for any loss or damage arising from your use of, or inability to use, the website.

Campaign statistics displayed on the leaderboard (helmet count, donor count, progress percentage) are updated manually and may not reflect real-time totals. Helmet Heroes does not warrant the accuracy of leaderboard data at any given moment.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Helmet Heroes Foundation, Inc., its directors, officers, employees, and volunteers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our platform or the making of a donation, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these terms or your donation shall not exceed the amount of the donation you made to which the claim relates.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles.

Where our activities involve the collection and processing of personal data of individuals in Thailand, we also operate in compliance with the Thailand Personal Data Protection Act B.E. 2562 (PDPA).

Any dispute arising out of or in connection with these terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of the State of Wyoming, United States.

14. Changes to These Terms

We reserve the right to update or modify these Terms of Service at any time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of our platform after any such changes constitutes your acceptance of the revised terms.

For significant changes, we will make reasonable efforts to notify donors who have provided their email address.
